Terms of service

These terms are an agreement between you and Yardsign (“Yardsign,” “we” or “us”) about your use of yardsignsites.com and the campaign websites we host. If you use Yardsign for a campaign, committee or organization, you agree to these terms on its behalf and confirm you have the authority to do so.

1. Who can use Yardsign

Yardsign is for Democratic candidates and their committees, Democratic Party committees, and progressive campaigns and organizations. You must be at least 18. We decide whether an account is eligible, and we may decline or close an account that isn't. Our acceptable use policy is part of these terms.

2. Your account

You sign in with a code we email you. Keep access to that email address secure; anyone who controls it can sign in to your account. Tell us right away at support@yardsignsites.com if you think someone else has used your account.

3. Prices and billing

  • Building and previewing a site is free. A site costs $39 a month from the day you publish it.
  • Subscriptions are billed monthly in advance through our payment processor, Stripe, and renew until you cancel. Taxes, if any apply, are added to your invoice.
  • Our prices are published and the same for every customer. Accounts with 5 or more published sites pay 15% less, and accounts with 20 or more pay 25% less. We don't offer private discounts, and we don't extend credit on terms we wouldn't offer any other customer.
  • If a payment fails, we'll email you and keep your site online for at least 7 days while you update your card.
  • We'll give you at least 30 days' notice by email before changing what you pay.

4. Cancelling

You can cancel any time from your dashboard. Your site stays online until the end of the month you've paid for, then goes offline. We don't refund partial months unless the law requires it. We keep your content and sign-ups for 90 days after your site goes offline so you can restart or download them, then we delete them.

5. Your content

You own what you put on your site: your words, photos and other material. You give us permission to store, copy, format, display and deliver it, only as needed to run your site and our service. You're responsible for your content and confirm that you have the right to use it, including every photo, and that it doesn't violate anyone's rights or the law.

6. Election law and disclaimers

Yardsign generates a “Paid for by” disclaimer from the committee details you give us and shows it on your site. We do this to make compliance easier, not as legal advice. Your campaign is responsible for the accuracy of your disclaimer and for following the campaign finance, election and communications laws that apply to you, including rules about text messages and email.

7. Supporter information

When people sign up on your site, we collect their information on your behalf and under your instructions. You control it and are responsible for how you use it. We encrypt it, show it only to your account, and never sell it or share it with any other customer. Our privacy policy explains how we handle personal information.

8. Domains

Every site gets a yardsignsites.com address. If you connect your own domain, you're responsible for registering and renewing it and for the DNS records that point it to us.

9. Availability and changes

We work hard to keep sites online, especially around elections, but we don't promise the service will be uninterrupted or error-free. We may improve or change features over time; we won't remove a feature you pay for without telling you first.

10. Suspension and termination

We may suspend or remove content or close an account that breaks these terms or the acceptable use policy, that's needed to protect people or our service, or that we're legally required to act on. Where we reasonably can, we'll tell you first and give you a chance to fix the problem and download your site.

11. Disclaimers

Yardsign is provided “as is.” To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

12. Limits on liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost votes, contributions, profits or data. Our total liability for any claim about the service is limited to what you paid us in the 12 months before the claim.

13. Indemnity

You'll defend and hold us harmless from claims arising from your content, your campaign's activities or your breach of these terms, and you'll pay the costs and damages that result.

14. Changes to these terms

We may update these terms. We'll email you about material changes at least 30 days before they take effect. If you keep using Yardsign after that, the new terms apply.

15. Governing law

These terms are governed by the laws of the United States and of the state where Yardsign is organized, without regard to conflict-of-law rules.
